# TFBthumb Beta Evaluation Agreement

This is a one-page agreement covering the evaluation of TFBthumb (the "Substrate"), a browser agent system operated by Trust Fund Baby Productions ("TFB"), by the organization receiving an API key ("Evaluator").

## 1. Scope

TFB grants Evaluator non-exclusive, non-transferable access to the TFBthumb beta API for a 30-day evaluation, renewable in writing. Evaluator may use the API for the purpose of evaluating whether TFBthumb meets Evaluator's needs. Production deployment, resale, and white-labeling are not authorized under this agreement.

## 2. What is delivered

- One or more API keys scoped to Evaluator's organization.
- Access to the wrapper API documented in [`API.md`](API.md).
- Access to the public proof surface at `projecttfb.com/tfbthumb/`.
- Bounded-claim set: exactly what is listed in `REVIEWER_PACKET.md §1` and `HEALS_v0_2_1_to_v0_2_2.md §3`. The boundaries in [`LIMITS.md`](LIMITS.md) apply by reference.

## 3. What is not delivered

- Source code of the Substrate.
- The HumanAuthority private key or any signing material.
- Production-grade availability, support, or SLAs.
- Any guarantee beyond the bounded-claim set.

## 4. Confidentiality

Evaluator agrees to keep confidential, for two years from the end of this evaluation:

- The contents of any TFBthumb wrapper artifact Evaluator receives (binaries, container images, API key strings).
- The contents of API responses that contain runtime traces, ledger receipts, or any information about Evaluator's own runs that has not been independently published.
- TFB's pricing, pre-release roadmap, and any non-public technical detail discussed in evaluation conversations.

The published bounded-claim set and the public proof surface are NOT confidential. Evaluator may reference them freely.

TFB agrees to keep confidential, for two years from the end of this evaluation:

- The contents of any pages Evaluator targets with the API.
- The contents of any task descriptions Evaluator submits.
- The contents of any ledger receipts generated by Evaluator's runs.
- The fact that Evaluator is an evaluator (we will not name you without your written permission).

## 5. Acceptable use

Evaluator agrees:

- Not to use TFBthumb to target a page Evaluator does not own or have explicit permission to automate.
- Not to use TFBthumb to violate the target site's terms of service.
- Not to use TFBthumb to send unsolicited communication, complete fraudulent transactions, scrape at a rate that interferes with the target's operation, or any other action that would be unlawful or unethical if a human did it manually.
- Not to attempt to reverse-engineer the Substrate or to extract source from API responses, binaries, or container images TFB provides.

TFB reserves the right to revoke API access at any time, with or without notice, if these terms are breached.

## 6. Liability and warranty

TFB provides the beta on an "as-is" basis. The bounded-claim set is what is verified; nothing else is warranted. TFB's aggregate liability under this agreement is limited to the fees Evaluator has paid for the evaluation, or $0 if the evaluation is unpaid.

Evaluator agrees to indemnify TFB against claims arising from Evaluator's use of the API to target pages Evaluator does not own or in ways that violate Section 5.

## 7. Term and termination

This agreement runs from the day the first API key is issued for 30 days unless renewed in writing. Either party may terminate at any time on written notice. On termination:

- TFB revokes all of Evaluator's API keys.
- Evaluator deletes any TFB-provided artifacts within 14 days.
- The confidentiality obligations in Section 4 survive for two years.

Either party countersigns by email reply on the thread that delivered the API key. No paper signature is required.
